Frequently Asked Questions
When should payments begin?
Payments are required to begin within 30 days of the filing of the plan.
|
What if we are unable to pay?
Contact your
attorney for advice. Provid information about your current financial
condition so that your attorney may contact the trustee.
|
How can we be sure a particular creditor is paid under the plan?
The creditor must be listed in the bankruptcy
schedules AND
must file a proof of claim in the Bankruptcy Court. Your attorney can check to
see if a proof of claim has been filed and if not, you have the right to file it
on behalf of the creditor. You will be receiving a Motion to Allow Claims after
confirmation of your plan. This will list all of the claims and how they will be
paid. Please review it carefully.
