Frequently Asked Questions
When should payments begin? Payments are required to begin within 30 days of the filing of the plan.
What if we are unable to pay? Contact your attorney for advice. Provid information about your current financial condition so that your attorney may contact the trustee.
How can we be sure a particular creditor is paid under the plan? The creditor must be listed in the bankruptcy schedules AND must file a proof of claim in the Bankruptcy Court. Your attorney can check to see if a proof of claim has been filed and if not, you have the right to file it on behalf of the creditor. You will be receiving a Motion to Allow Claims after confirmation of your plan. This will list all of the claims and how they will be paid. Please review it carefully.
What if we have other questions about our chapter 13 plan?
